General terms & conditions

KACB (Kerry-Ann’s Cake Boutique)

Here at KACB it is our aim to fulfil the order that you have placed with us and where possible exceed your expectations.

The purpose of these Terms and Conditions is to be clear about what will happen in the event of something going wrong. We want what is best for both parties, now and in the future.


QUOTATION

Your quotation is valid for thirty (30) days from its issue date. The figures stated in the quotation are specific to the design, the size and/or number of items stated in the quotation.

BOOKING FEE

The booking fee is required in order to secures your event date in our diary and is non-refundable under any circumstances. A design sketch and detailed order form cannot be created until this payment is made.

CONSULTATION FEE

The tasting/design consultation fee covers the cost of the time and products created to fulfil the consultation meeting. The meeting is specifically for the 2 individuals who are getting married. Additional individuals are not permitted unless agreed otherwise by KACB. There will be an additional charge applied for this.

ORDER FORMS AND PAYMENT

The payment schedule will be outlined in your Order Form. The booking fee terms are as stated above in Section 2.

Cleared payment of the entire balance must be received by the due date shown and no later than 4 weeks before the event date as stated in the order form.

In the event of non-payment of the balance, we reserve the right to consider the order cancelled and the booking fee forfeited.

DESIGN AMENDMENTS

The purpose of the design sketch is to ensure that you, the client, are happy with the design concept. The sketch is not intended to be an exact replica of the cake that will be created. The detail in the order form will clarify in written form, the design elements, flavours, sizes and cost.

Up to 3 rounds of amendments are permitted at no extra charge. Please bear in mind that some amendments may alter the price of the design. You will be required to confirm on email that you agree to the design and that KACB will proceed with the work on that basis.

DELIVERY & SET UP

Any delivery and set up charge will be outlined in your order form

KACB is not responsible for any damage to the cake/items delivered/end product once delivery and set up is complete at the event venue.

A signature will be obtained at the venue by a venue representative to confirm that all items delivered and set up are in perfect order. A copy of the signed delivery form is available upon request within 30 days of the event date.

KACB are not responsible for any damage to the cake/edibles/end product after setup is complete.

Cakes are heavy and require a sturdy table, and a suitable environment for which you, the client are responsible. You acknowledge that some cakes/edibles will have fixings attached (i.e. board pins) and the removal and disposal of these are the client's responsibility in conjunction with the event venue.

If fresh flowers are used to decorate your cake, you acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants (see ‘environment’). Every effort will be made to ensure that the stems of fresh flowers/foliage are not in direct contact with your cake (i.e. a vessel such as a cake pick, straw or cocktail stick) will be placed directly into the cake, thus shielding the stem from direct contact with the cake.

KACB takes no responsibility for contamination of fresh flowers on your cake.

If you or your representative elect to pick up and set up your cake, you assume all liability and responsibility for the condition of the cake once it leaves KACB possession/premises.

We (KACB) usually photograph our cakes on site and reserve the right to use any photographs we have taken, for display or promotion without your permission or compensation to you.

ALLERGENS

Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens and are not responsible for any allergic or adverse reactions to you or your guests or anyone who comes into contact with your cake/items that KACB have supplied. You agree to notify your guests accordingly and are solely responsible for doing so.

If special dietary requirements were stated, they would be outlined in the order form supplied by KACB.

CANCELLATION

Orders which are cancelled by you, the client, at short notice (within one month of the agreed delivery or collection date) will still be charged in full.

We must receive the balance by the due date indicated or the contract is null and void. The booking fee is non-refundable in any event.

In the unlikely event that KACB have to cancel your booking due to unforeseen circumstances at full refund of the booking fee and balance payment will be given (the consultation fee is not included and is non-refundable).

FORCE MAJEURE

Neither you, the client nor KACB shall be liable for failure to perform our (KACB) part of the contract, if the failure is due to force majeure events (including fire, flood, earthquake, storm, hurricane, natural disaster, war, civil war, invasion, act of foreign enemies, hostilities, rebellion, terrorist activity, government sanction, change of law, strike, lockout, industrial action, embargo, sabotage, global or local pandemic and/or other causes beyond our control.

In such an event and if at all possible, whilst a refund or partial refund will not be available, KACB will endeavour to work with the client to transfer and fulfil the order (or the value of the order) to an alternative date, subject to availability.
